Benjamin Kenkel Obtains Favorable Ruling in U.S. Court of Appeals for the Eighth Circuit

In a matter important to architects, commercial developers, bankers and building owners, Bradshaw attorney Benjamin Kenkel was successful before the United States Court of Appeals for the Eighth Circuit for client Northern Cedar Service Co., Inc.  The appeals court agreed with the district court in upholding a decision to reject the plaintiff’s argument that a partially completed building could not be sold in a bankruptcy court matter without infringing on the architect’s intellectual property rights. The court ruled that the question of intellectual property rights was decided in bankruptcy court with the approval of the sale of the building in question.
