Bradshaw Attorney Blake R. Hanson Obtains Favorable Outcome Before Iowa Court of Appeals

On March 17, 2021, Bradshaw attorney Blake R. Hanson received a favorable opinion from the Iowa Court of Appeals affirming the district court’s dismissal of Plaintiff’s medical malpractice lawsuit on behalf of his client healthcare provider in one of the first appellate decisions to address the scope of Iowa’s certificate of merit requirement codified in Iowa Code §147.140. Following Plaintiff’s failure to comply with §147.140, the district court dismissed Plaintiff’s lawsuit. On appeal, Blake Hanson briefed the case on behalf of his client and argued his clients’ position before the Iowa Court of Appeals who ultimately accepted his argument that Iowa Code §147.140 applied to Plaintiff’s claims, that the Plaintiff failed to substantially comply with the requirement, and that the district court did not abuse it’s discretion in determining that Plaintiff failed to demonstrate good cause to extend the deadline. Plaintiff’s request to the Iowa Supreme Court for further review was denied.
