On Tuesday, September 12, 2017, Bradshaw attorneys Jason T. Madden and Robert J. Thole successfully obtained a summary judgment ruling dismissing a lawsuit against a western Iowa resident. The opposing party brought a gross negligence claim against the defendant, alleging the defendant’s conduct in the operation of a fork lift at work was grossly negligent in causing his co-employee’s personal injuries. The Court ruled that the opposing party did not meet its burden to overcome the defendant’s argument that his operation of the forklift was not grossly negligent as is required for bringing a lawsuit against a co-employee pursuant to Iowa law.
