On January 15, 2015, Bradshaw attorneys Janice M. Thomas and Seth R. Delutri successfully obtained a summary judgment ruling dismissing a lawsuit against an insurance agency. The Plaintiffs asserted claims for breach of contract, negligence, and breach of fiduciary duty, alleging the insurance agency failed to provide insurance advice and consultation. The Plaintiffs alleged the Defendant insurance agency failed to ensure it retained or obtained workers’ compensation coverage. On January 15, 2015, the District Court ruled the insurance agency met their duties under Iowa law by providing the insurance requested by the Plaintiffs. On January 27, 2016, the Iowa Court of Appeals affirmed the District Court’s ruling. On March 21, 2016, the Iowa Supreme Court denied further review of the case, thereby upholding the decisions of the District Court and Iowa Court of Appeals.
